Trailers.com Owners Agreement

1. Selling. By listing your Trailer for sale through the Services, you acknowledge and agree that:

a. the trailer you list for sale is in your possession;

b. you have the right to transfer the advertised trailer's title to the purchaser;

c. you are willing to sell the advertised trailer at the price and on any other terms specified in your listing;

d. you will purchase only one listing per unique trailer and you will not advertise more than one trailer in a single listing, either by including descriptions of multiple trailers in one listing or by subsequently updating the listing information to advertise different trailers;

e. upon selling or otherwise taking your trailer off the market, you will within 48 hours delete the listing for that trailer;

f. you will not use your listing to advertise or promote anything (including, without limitation, any product, service or business) other than one individual trailer offered for sale;

g. you will pay Trailers.com the applicable fee for your trailer sale listing, even if you fail to sell your trailer;

h. in the event that You make a material error in listing a trailer for sale that cannot be corrected through the Trailers.com provided tools, you will contact Trailers.com customer service within 5 days of your original listing date to inquire about making material changes to your listing (e.g., through a typographical error, you listed the wrong model for sale) and Trailers.com shall determine, in its sole discretion, whether such changes may be made; and

i. photos provided for your trailer listing will only show the trailer listed for sale and may not include under any circumstances people, animals, or other objects not part of the trailer.

2. Renting. By listing your Trailer for rent through the Services, you acknowledge and agree that:

a. the trailer you list for rent is in your possession and you have title to it;

b. you are willing to rent the advertised trailer at the price, and on any other terms, specified in your listing;

c. you will purchase only one listing per unique trailer and you will not advertise more than one trailer in a single listing, either by including descriptions of multiple trailers in one listing or by subsequently updating the listing information to advertise different trailers;

d. you will promptly communicate with the Renter to negotiate and execute a rental agreement on the terms specified in the listing and/or other terms agreed to by the parties and not inconsistent with the Member Rental Contract as defined in the Trailers.com Service Agreement;

e. whether you upload your own rental agreement or utilize a sample Member Rental Contract, you have made a binding offer to rent upon such advertised terms and consent to Trailers.com affixing your signature electronically upon your preselected agreement;

f. upon agreeing to rental terms or otherwise taking your trailer off the market, you will mark your trailer as unavailable;

g. because taking your trailer off the market after a Renter has agreed to your terms can lead to disappointed and frustrated Renters who may be less likely to rent from Trailers.com, you may be charged a fee for taking your trailer off the market after a Renter has agreed to your terms;

h. you will not use your listing to advertise or promote anything (including, without limitation, any product, service or business) other than one unique trailer offered for rent;

i. in the event that You make a material error in listing a trailer for rent that cannot be corrected through the Trailers.com provided tools, you will contact Trailers.com customer service within 5 days of your original listing date to inquire about making material changes to your listing (e.g., through a typographical error, you listed the wrong model for rent) and Trailers.com shall determine, in its sole discretion, whether such changes may be made;

j. you agree to indemnify Trailers.com, should the Renter fail to adhere to the terms of the listing and/or Member Contract, including but not limited to, their complete failure to return the trailer;

k. photos provided for your trailer listing will only show the trailer listed for rent and may not include under any circumstances people, animals, or other objects not part of the trailer.

3. Trailers.com reserves the right, in its sole discretion, to remove any listing or photo, without notice and without liability or providing a refund, that does not meet the requirements of this Agreement, Trailers.com’s policies, or if Trailers.com otherwise determines or believes, in Trailers.com’s sole and exclusive discretion, that your listing or any photo or other content you upload is inappropriate for any legal, business, technical or other reason.

4. If you are an Owner, you represent and warrant that you shall carry at least the minimum automobile liability insurance required by law, at all times. Trailers.com does not maintain insurance for rentals transacted through our Services. If you have questions regarding coverage terms and amounts, please contact your insurer.
